1. Agreement to Terms

By accessing or using SmoothyEdit, operated by Ali Ahmad (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.

2. Description of Service

SmoothyEdit is a software-as-a-service (SaaS) platform that provides AI-powered video editing assistance tools, including but not limited to: finding best shorts clips, generating hooks, creating titles, writing descriptions, thumbnail ideas, B-roll suggestions, and audio transcription.

3. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.

You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. Subscriptions and Payment

Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set on a monthly basis.

Merchant of Record: All payments are processed through Paddle.com, which acts as our Merchant of Record. This means Paddle is the legal entity that sells the Service to you, handles payment processing, billing, sales tax, and refunds on our behalf. By subscribing, you also agree to Paddle's Terms of Service and Privacy Policy.

A valid payment method is required to process the payment for your Subscription. You shall provide accurate and complete billing information.

Refunds: We offer a 14-day refund policy for first-time subscribers. Please review our Refund Policy for full details on eligibility, consumer cancellation rights, and the refund process.

5. Free Trial

SmoothyEdit may offer a free tier or trial period at its sole discretion. You may be required to enter billing information to sign up for the Free Trial. Features available during the free tier may be limited compared to paid subscriptions.

6. Cancellation

You may cancel your Subscription at any time through your account settings or by contacting us at support@smoothyedit.com.

Upon cancellation, your subscription will remain active until the end of your current billing period. After that, you will no longer be charged, and your access to premium features will be revoked.

7. Digital Content & Consumer Rights

SmoothyEdit provides digital content and SaaS (Software as a Service) products. By using our Service, you acknowledge that:

Nature of Service: The Service provides AI-powered video editing tools accessible through your web browser. No physical products are delivered.
Consumer Cancellation Rights: If you are a consumer, you have the right to cancel within 14 days of purchase. See our Refund Policy for full details on exercising this right.
Digital Content Exception: Once you begin using the Service's features, you acknowledge that immediate performance has begun and you may lose certain cancellation rights for that billing period.

8. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of SmoothyEdit and its licensors.

You retain ownership of any content you upload to the Service. By using the Service, you grant us a limited license to process your content solely for the purpose of providing the Service to you.

9. Acceptable Use

You agree not to use the Service to:

Violate any applicable laws or regulations
Infringe upon the rights of others
Upload malicious code or attempt to compromise the Service
Use the Service for any fraudulent or harmful purpose
Resell or redistribute the Service without authorization
Attempt to reverse engineer or extract source code from the Service

10. Limitation of Liability

In no event shall SmoothyEdit, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

11. Disclaimer

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
